Hi All,

Currently i'm working with a company named "X" and they want to file my labor perm. i may not be working very long with this comp. i wanna change very soon when i get a permanent job with company "Y" who sponsor my H1.

Now my question is there any problem if i apply labor perm and I140 with company "X" now and later apply with company "Y".

Thanks in Advance

You need to start again with Company 'Y' if I-140 is not approved before you leave the company called 'X' or if approved you need to reapply again but with the priority data using the earlier one.

You can only secure your company X priority date if they file the PERM, the PERM is approved, they file the I-140, and the I-140 is approved. Then, you would have to do your PERM under company Y and only then can you do a re-capture at the I-140 level. Your company X would have to agree to continue your processing and not withdraw your I-140 as well. I guess it depends how good your relationship is with the employer.
