RD or ND before Jan 1,2005 wrt Retrogression?

Is it enough for the I-140/I-485 to be filed BEFORE January 1, 2005 ?

Is it ok if the case is recd by the Service Center before Dec 30,2004 ,or do we need a ND of Dec 30,2004 ?
 
I would like to believe its RD but I don't know the answer to your question. I am in the same boat. My RD is Dec 21st.

Lets hope I get the ND before 1st Jan! Will update if that happens. You do the same. Anybody who knows?
 
Labor Priority date

I guess it should be RD on or before December 30, 2004. Getting ND will be atleast one to two weeks after they receive it. In fact there were cases the actual RD for the application is not the day the mail was received in the mail room. An interesting situation!!!

Also, Check what is your labor priority date. It can be found on I140 approval notice or Labor certification. If the state labor receive date is before Jan 1, 2002 you are ok, or else have to wait your labor PD become current.

I think RD will do guys. I read this somewhere:

There are two big changes to be taken place between 12/31/2004 and 01/01/2005. One is the EB-3 visa cut off date for Indians, Chinese, and Philippines. The other is the permanent labor certification application filings in the two-tier processing system until 12/31/2004 and one-tier processing system beginning from 01/01/2005. In both the USCIS and the USDOL, the filing is not effective until the cases are "physically receipted" by the agencies and post-mark or commercial pick-up is not enough. The consequences of ongoing flight cancellation involving COMAIR of Delta Airlines, UPS and Fedex flights will be more devastating for the I-140/I-485 concurrent filers before January 1, 2005 than the labor certification filers.

Warning: The last day is 30th not 31st!!
 
Let's hope it's the RD date.

I am also in the same boat. USCIS received my concurrent filing papers today (12/28). I don't expect to receive the A# in this year.

which center? and were all ur papers sent to the center or some were sent to chicago lockbox? all as in 140/485/AP/EAD?

All the papers 140/485/EAD/AP were sent to VSC Vermont Yestarday and they received Today.
