There are two big changes to be taken place between 12/31/2004 and 01/01/2005. One is the EB-3 visa cut off date for Indians, Chinese, and Philippines. The other is the permanent labor certification application filings in the two-tier processing system until 12/31/2004 and one-tier processing system beginning from 01/01/2005. In both the USCIS and the USDOL, the filing is not effective until the cases are "physically receipted" by the agencies and post-mark or commercial pick-up is not enough. The consequences of ongoing flight cancellation involving COMAIR of Delta Airlines, UPS and Fedex flights will be more devastating for the I-140/I-485 concurrent filers before January 1, 2005 than the labor certification filers.
