Qusetion on applying for I-140 & I-485 beeing my child in India.

Hi Every one,

Earliest members responses are greately appreciated to my question below:

My labor got cleared in May 2003 and I need to apply for I-140 and I-485. We are family of four me, my wife, son and daughter. Me, my wife and my son are here in US and presently my daughter in India. So here my question,

Q: can I apply for I485 for my daugher beeing Medicals done in India and get the medicals here by mail and apply 485 along with our 485 here in US and opt councilor processing only to my daughter in India, and if not is this possible to apply for my daughter after three months are so after we have filed 485?

To apply for I-485 the applicant has to physically be present in the US at the time of filing. Moreover, the medical examination has to be done in the US by a BCIS designated doctor, it cannot be done in any other way. I don't think you can designate consular processing for one family member only, it is either all or none. You can file I-140 now along with concurrently filing 485 for everyone present in the US and later file 485 for your daughter when she returns to US.
 
Your daughter should be here to apply before your GC approval otherwise I afraid it may take 3-5 years to get her GC approved.
 
Medical after applying I-485?

We applied for I-140/I-485 in December'2002 but we didn't send the medical reports.
1.Can we send medical Examination reports after we applied for I-485? or we should wait for INS notice to send the medical reports?
2. Our child is in india, Can we get medical reports from india or she has to be here in USA for the medica examination?she has applied for I-485.
3.If we can send the medical reports when should we send those?
