Quick Question

I know this has been talked about many times before on this forum , but i am unable to search the forum for an answer.

My friend has applied for I-140 in Oct/03 at NSC which is still pending, he is planning to get married in about 4-5 months time.

Question is , can he apply for 485 right now ( probably next week )before his marriage, and then get his wife here on H4 and then apply for 485 for her once she comes to US. Is this possible ? Kindly let me know.

Yes - for everything. Make sure your friend continues to work on H1B status to get his wife in the US on H4.

a question though...

I thought one needs AP after applying for adjustment of status (i485) before they can leave the country! If so he needs to make sure, he get the AP before he leaves. Am I right here..?

If the AOS applicant is also a H Visa holder he can travel using that and AP may not be used.
