Folks:
My friend was on h1 some four years ago and his Labor & I140 was complete with the company he worked with (let's say company A).
While filing for I485 he got laid off and he had to move to a different company
(Company B) and he finally went back to his home country in 2002.
He came back to US on h1 this time with company C. Now he is planning to apply for Labor/PERM. He has a question if he can substitute the labor/I140
from Company A in which he not only doesn't work any longer but also it's been >5 fives since they got approved?
Personally I think that he cannot sub the labor/I140 but I just wanted to make sure that any one of you Guru reading this posting have a second opinion.
