Hi

Got a quick question guys, applying for green card through wife, she doesn't qualify as sponsor though cause she had no job, so using her dad as a sponsor, my question is, does she have to write a letter why I won't be submitting any tax forms in her name, cause she didn't fill out taxes, considering she had no job.

Thanks

She is still the sponsor, her dad is a co-sponsor or household member. It's important to know that distinction, because on the forms wherever they ask for information about the "sponsor" they mean her, not her dad, even though her dad is providing the finances.

You don't need to write any letter like that for the lack of tax returns. She should simply leave question 25 of the I-864 blank, and then provide her father's tax transcripts or returns along with an I-864A filled out by him. Or if you have legally authorized employment, you can list your income on the I-864 question 24 and her father doesn't need to get involved.

Got another question now though, do I have to fill out an I-864 for her dad also as the co-sponsor?? or joint sponsor as they call it? or the I-864 is just for the wife, and for her dad just fill out the I-864A?

Appreciate it.
