Quick Naturalization question. Can I apply?

Hello,

I would appreciate if you can answer my question. I got my green card through my employer but my wife is an American citizen now. She had her independent green card when we married and bacame a citizen some time back.

Can I apply for naturalization in just 3 as years as opposed to 5 years now even though my green card was employment based?

Sure, you can apply based on a 3 yr rule if you have been married and living with your American wife for 3 years.

But, I think the 3 year rule is a little strict and also involves a few extra documents like Joint Accounts Statements, Mortagage papers, tax papers where taxes are filed jointly. etc.

Do a google on this forum and i am sure you can find a "SEA" of information to that effect.

Also, your wife must have been a US Citizen for at least 3 years for you to be eligible to apply.

You can be naturalized as a USC on the earlier of:

5 years from your green card date
or
3 years from the date of your Wife's Naturalization if your N-400 application is marriage based.

(If the two end up being almost at the same time, go for naturalization based on the 5-year GC - less paperwork required)
