Gentleman,

I have some questions about social security.
What happens if they do not give our GC and we are forced to go home. Do we loose all these years we have been paying for?
What happens if one dies or get invalid and cannot work. If one cannot work because is dead or invalid he will not have a job when the RFE comes, then no GC. What happens to all that money he paid during 5,6,7 or more years. How about his family?
Will they have the right to stay? Will they be forced to leave? Will they receive any benefits, pension or whatever they would be entiled to in a normal situation? If you paid for something you shoud have the right to it or they should return the money. What do you all think?

i think it requires

you to work 10 years to get social security. if you die or become handicapped you do get a percentage. the letter which social security department sends out does explain those specifics

You need to earn 40 credits. Each year you work you can earn up to 4 credits. You don't need to make very much money to earn your 4 credits. If you are from a country having a tax treaty with the US, such as Canada, you are entitled to benefits without earning the 40 credits. That is because Canada and the US have an agreement covering income tax and social benefits.

Looks like jlsbr is serious about the idea of "going back home". Personally, I doubt you would get any benifit if you are physically out of this country say back in Asia without a USA citizenship.

Jlsbr: Good qustion. More people are getting approved recently. What is your RD? Just hang on there for a while.
:D

I have been working here since I came here back in 1991 as a student. I don't have a GC and I don't have 40 credits either. I wonder what happens in my situation too.

Hope somebody knows the answer in this group!
