Questions related to I-864

Hi,

I am currently working in the United States and have an employment based derivative I-485 pending. My husband will become a US citizen soon and will be sponsoring me for I-130 and I-485.

I have a few questions related to I-864 (Affidavit of Support)

1. Does the form have to be notarized?

2. I am including the following supporting documents for I-864. Is this enough or do we need to include any other supporting documentation?

a. 2 years of tax returns
b. 2 years of tax transcripts
c. 2 years of W2s
d. Employment verification letter for both my spouse and me
e. Last 2 paystubs for both my spouse and me

3. Are we required to submit bank statements and mortgage documentation to support information on assets?

Thank you for any suggestions you can provide.

2. Enough, but I'd include paystubs for last 3 months or so (just in case).

3. If both of you together makes more then 125% poverty level (something like $20K/2 people) you don't need to fill any assets at all. If not and you use assets as "supplement income" to make up the poverty level then yes.
 
To follow Sonia's question,

In my package, I only included my husband's WSs and Tax returns (a and c by Sonisa's numbering) and didn't include the paystabs at all since he is now running his own company.

Will I get a RFE?

Only requred is personal tax forms with all atachments for one last year.

In interview letter you are REQUIRED to bring paystubs if not submitted. So it's just easier to submit in first place. They may not ask for them at the interview, but they are in list of required docs.
 
Our immigration advisor told us to submit my USC husbands paystubs for 6 months... so we did.

Always submit everything they list in the forms.. or else you may get an RFE and it will set your case back.

We included everything that was asked on the forms. See my timeline below, we did not get an RFE (request for evidence). I had a friend who got an RFE because she forgot to include one small thing.

The form doesn't ask for the small things. It asks for the evidence required. The paystubs are not required on any family based forms.
 
That must be an old edition. USCIS lifted that requirement when they updated the relevant form (I-864). Now, what could happen: if you have the stubs submitted that do not correspondent to the tax return required, it might lead to the problem, which could have not be there otherwise.

When did that happen (not picking on you, just curious as I havn't heard about that)? My letter dated May, 2009. :)

Current pay stubs (current or YTD amounts) need not and not necessaryily should match amount shown in individual tax return, if that would have been case how would you explain an increase in pay ?. Requirement for submission of pay stubs are ever since with I-864
 
That change has happened last year or so. They just use old computer software to generate the notice.
You might be right that the stub won't harm in most situations, but in general it is not a good practice, next, look, on the interview they will want the original, chances are you sent a copy, then there is a gap between filing and the interview so whatever you sent is dated.

That's good for you if you get an increase, but what if not?
