Questions regarding obtaining F-1 visa: Gurus please help!!

RE: F-1 visa interview at the consulates

My wife and I came to USA many years ago as students, after completing education I started working here, I got my EB green card and my wife also got a green card at the same time as a dependent.

Now my wife\'s brother is planning to come to USA as a student (admitted to a good school here, received I-20 etc.). He doesn\'t have financial aid and his parents will be sponsoring him. Since my wife and I have green cards, will that affect his chances of getting a student visa? (in terms of intent of immigration)

His case is little complicated since couple of years ago his visitor\'s visa ( we wanted him to visit us during x-mas) got rejected since he did not have a letter from his college indicating that he was visiting USA only during the semester break. He did not reapply that time (for a visitor\'s visa) since he did not have enough time to arrange for missing documents.

Some people advised that he should NOT tell the consulate officer that his sister is in USA since they have no way of finding this out. That way he will not have any problems.

Please let me know what you Gurus think??

Please do not take chances depends on consulate

But do keep in mind that if you apply at the same consulate the chances are that your past history of applications for a visa can be retrieved. Someone in the back room could always be inputing data of applications and computerising the visa system. If two or more consulate are not linked up then it is a different game even then if there are some visa denial entries/stamps in passports you need to think about this. Given the complexity of the case your brother-in-law has best chance to be in US by H1 visa, if he is eager to study he can always change status to F1.
