Questions regarding I130&1485

Hi, Everyone,

There are a few question I encounted when I fill my I130&I485 forms. Application is through my wife(USC). Cause I am doing this all by myself, I am pretty nervous. Any help will be really appreciated.

1. On the I130, question 22 asks me what USCIS office I will apply for adjustment of status. I am living in long island, NY now so I should put in "New York, NY" here?

2. I485 part 2 application type, am I type a?

3. About the birth certificate(I was born in China), I have one I brought from China in Chinese and corresponding English translation. Is that enough? Will INS accept that? Do I have to give it to notary here to do translation again?

4. for I-864, affidavit of support, my wife's income is enough to pass the 2006 poverty line. I am just wondering including my income is gonna help or not?

5. Forms ask about Alien registration number. There is no A# for citizen, right? or do we have to dig that out from my wife's old green card?

One last small question, when I print out these forms, is double-side or single-side matter? for more than one-page forms, just put them in a folder or staple them together?

Yes. The nearest USCIS office that has jusridiction over your area of residence

2. I485 part 2 application type, am I type a?
Yes

As long as you submit a copy of the original birth certificate and the original translated copy, it should be fine. The requirement for the translation is to certify and not notarize. You could notarize it if you wish, wont make a difference.

If sponsor alone meets or exceeds minimum requirements, you dont necessarily have to include your income. It is your decision anyway as it wont affect your applcation eitherways.

If your wife was naturalized, she would have an A# she got from when she became a LPR.

The instructions are out there on the USCIS website. You need to do a little homework ;)

Thanks for quick reply. Yeah, I am studying these instructions now. Still two more questions.

1. Sorry about misunderstanding between notarize and certify. My birth certificate I got in China has both English and Chinese version. Do I have to go to some translation places in US to get that english part certified?

2. By reading the instruction on uscis website, I still did not get the answer about double or single-side print. The only part I found is this
"An electronic reproduction of a multi page form does not need to match the head-to-head or head-to-foot printing configuration of the official form. In the case of the Form I-20 A-B/I-20ID, Certificate of Eligibility for Nonimmigrant (F-1) Student Status--For Academic and Language Students, private entities may generate this form in single-page format rather than double-sided format, provided that the student's name, school, and date of birth is printed in a shaded box on the top of page 4 of the form, using the same type size and font style as the body of the form."
