Questions regarding H4 to F1 Conversion?

Hi All,

I am planning to get my wife's visa converted from H4 to F1.
Her M.S course has started this Fall'2004 and she is currently going to school.
The school does NOT mandate my wife to be on F1.

My employer has filed GC from Wisconsin in August'2004 and currently is in the STATE labor stage.My H1 visa will expire in Nov'2005 and my wife's course will be completed by May'2006.So in order to complete her studies she has to stay beyond my 6th year H1 visa period and of course I'm planning to apply for my SEVENTH year H1 visa extension.

1) Can we apply for visa conversion with in US or we need to go to India?

2) When my wife apply for F1, It seems like we have to provide proof of return to home country after she completes M.S degree.
During F1 conversion interview can she mention “My husband's GC is being processed” or should we not specify that.Will that be a problem?

3) Can I mention that I'm the sponsor for her studies in U.S. while she is on F1 visa?

4) What are the chances of approval from H4 to F1 visa?

5) In case if F1 visa is not granted for whatever reasons can we have my wife's H4 visa back so that she can travel to U.S?

6) Has anyone done this kind of conversion from H4 to F1 visa and can share their experience?

7) Is it OK for my GC processing if my wife converts her visa from H4 to F1?

8) Does my wife visa has to convert back from F1 to H4 to be included in GC processing?

9) At what stage of GC can I include my wife in the processing?

10) What are the pros and cons of this conversion?Any pitfalls and other things we need to look for during this conversion.

We had filed for COS for wife from h4 to f1. We received intent of denial from ins. They have asked her to explain why she wants to change her status. Now this is a very tricky question. We are going to consult attorny to reply INS. We also have similar questions that you have asked in our mind.
We will appreciate if somebody throws light on this issue.
