Hello Everybody,

I have a few questions as below and hope some of you will have
answers to these.

How long does it take for a spouse abroad to get a US green card
after one becomes a US Citizen? I assume I-130 and I-485 are the
only documents that need to be filed from the spouse's country of
citizenship with the US emabssy?

Is the wait/processing time listed anywhere? Is it quicker if my spouse
has canadian citizenship?

If we have a kid before she gets her us green card and before I
become a US citizen, would our kid need a seperate I-130 and I-485
as well? How long is the wait time?

if our kid is born after I become a us citizen can I file a N-600K?
What is the wait time for this?

Thanks

I-485 is for adjustment of status and that means the person has to be in the US already on a valid visa (preferably one which allows immigrant intent). In your case your spouse would have to go through consular processing at the US consulate in her home country or you have to bring her to the US first on a spouse visa (K3) which requires a I-129F petition to be filed and approved. The processing times for each of these application types can be found here

https://egov.uscis.gov/cris/jsps/ptimes.jsp?

Just pick the service center that applies to you.

I don't think the Canadian citizenship would speed up anything. Your spouse would be eligible for a green card under the immediate relative category and so the country-based quotas would not apply. Also I think the country-based quotas take the country of birth into account. She could visit the US on a visa waiver but again this program does not allow immigrant intent and it would be risky to apply for adjustment of status after entering on VWP.

The kid would have to be in the US on a green card to automatically become a citizen when you become one. Else you would have to first bring your kid to the US on a K4 visa or green card (which will take the same amount of time as it takes for your spouse).

Ok so I would need to file I-130 and I-129F for my spouse with the appropriate service center (VSC) in the US. Can I apply for I-130 and I-129F together?

The K3 visa would be issued after I-129F approval. How does this process of k3 visa issuance work ? Is there an interview for K3 visa? Would they mail me K3 visa approval here in the US or my spouse in Canada or the country in which we got married - India.

I haven't gone through the process myself but the way I understand it you need proof of having filed I-130 before you can file I-129F and so there may be a bit of a delay there (you have to wait for the I-130 receipt and attach a copy to your I-129F application).

Once the I-129F is approved I suppose you have to send the approval notice to your spouse in India along with the other supporting documents and she will have to schedule a visa appointment at one of the US consulates there. They may send a copy of the approval notice directly to the beneficiary too (you may want to look through the K3-related posts on this forum) but you will have to provide the rest of the documents (affidavit of support, proof of your citizenship, etc).

No You Do Not Need Proof Of I-130

You Do Not Need Proof Of Form I-130, To File F129, You Can File Both Together, Do Not Let Anyone Confuse You, There Is No Law Say You Have To Get A Proof Of 130 To File F129, But You Must Have The Proof You Did File A I-130 , And How Do You Do This? Simple

Make A Copy Of Form 1-130 With Your Check, And Then Attach The Form With Your Form F129 And Mail It WiTH Appopriate Fees, And That Is All You Need, --

I Did That Way And It Work They Accept My Application And They Send My Reciepts, (BOTH FOR FORM I-130 AND F129)

To Check If I Am Telling You The Truth, Read From F129 Instruction, And You Will See It Says, You Need A Proof, That You Have File, Not A Proof Of Reciept You Have File, Most People Get This Two Form Wrong-- Please Go And Download The Form And Read, And You Will See I Am Telling You The Truth, Because I Am Living Witness Who Have Done It And It Work,

Good Luck
