I have 140/485 pending. Got EAD (one year). I am in H1 and won't use the EAD at this moment. My wife is in H4. She plans to use it. In the case my 140 is denied, can she transfer back to H4 if my H1 is still valid? If yes, how soon we are allowed to do that after 140 denial? Can we do that ourselves or through my company's attorney?
Also I am planning to visit my home country. If I use the AP for reentry, can I still stay at H1 status?
