Hi,

I have few questions.

1. I have applied for PR in canada one uear bacj and has been approved now. I may be going to Canada anytime next month for stamping. At present my LC has been filed and is in DOL, Chicago. WIll canada PR affect my GC processing in US ?

2. I have changed my employer in June this year. I have visa stamp of old emplyer in my passport and have I-94 till Feb 2006. Can I use that I-94 to renter to US after my visit to Canada ? If not, do I have to go for stamping in Canada ?

3. I have H1 approval notice for new employer but my wife's H4 is still pending. If I have to get stamping in Canada, can my wife will get stamping
with my stamping.

Sorry for too much of questions.

Much thanks.

>>> NO

>>> If you have valid visa (not expired from your old employer) then you can rerenter using I-94 ( the one in your new approval)

3. I have H1 approval notice for new employer but my wife's H4 is still pending. If I have to get stamping in Canada, can my wife will get stamping
with my stamping.

>>> Your wife can get stamping with your stamping, but if you want to stamp her alone you might need her approval.

Much thanks.[/QUOTE]

*** Could you please explain how your wife's H4 is still pending. Because there is no petition for H4. The H1 holder sponsors spouse's H4. It should also be valid untill 2006. Because the experation date of H4 is the same as H1 primary visa experation date.

My employer has filed my wife's H4 pettion one month after they filed my H1 pettition. My h1 wa filed in May 15th and got approcal notice in June 15th. But my wife's pettion was filed on June 25th only.

Yes, I have valid I94 of my old employer. My old employer informed INS to cancel my visa once I left the company. So while rentering into US using old employer's visa stamp, will it not create problem ? Beacuse in airport normally they will ask whether I am working in that company only. Will it create problem even though I have approval notice of new employer ?

Nop, You tell the Officer that you work for new employer & show new approval. You should also have new I-94 with approval (botton part), Attach it to the passport over your old I-94.

You Do not need new Visa untill current visa in your passport is still valid.
