Hi,
I am a RN and currently in F1 status, which will expiry on 01/01/03. I have already filled my I-140 petition to Vermont, and now I am preparing my I-485 documents. I have couple of questions to ask:
1. Usually how long I will wait to get the I-140 receipt from INS in Vermont?
2. I was told I can file I-485 with I-140 receipt from INS. Is this still true?
3. After I-485 is filled to INS, can I legally stay in USA after 01/01/03 if I do not received the approval of I-485 from INS then? That is whether I can stay in USA with an expired F1 visa after my I-485 is filled and received by INS?
4. Do I need include my Medical Examination with my I-485? If yes, do you know how long it will still valid after the exam date? Because I don't know when I can receive my I-140 receipt and then I can file my I-485 petition with the Medical exam.
5. How long I will wait to get the result of Medical exam usually?
6. How about the fingerprint? When should I have it done? Waiting for notice from INS?

Please help me figure out above. Thank you in advance.

1. Currently 140 takes about 60-90 days based upon the recent patterns I have noticed.

2. Yes. You can do a concurrent filing as well.

3. Yes. Since your status is an adjustee. So may stay in the country until INS makes a decision on your case.

4. Yes. Medical examination documents are required. Without it your 485 application is technically incomplete. Possible grounds to denial - read info on 485 on the INS website.

5. Once you schedule your medical exam appointment with doc. It normally is a week to two weeks. Again depends on if you have to get further vaccine shots or needs further testing to confirm your medical condition.

6. INS will send you information on when to do it and where. Make sure that you pay the fingure print fee along with your 485 application and fees.

Hope this helps.....
