Questions on AP

Hi,

I may visit india on AP(have valid H1B visa but not stamped on passport). Please help me with the following.

1. Do i need to return before 60 or 90 days?
2. What happens if my 485 is approved when iam in india?
3. What happens if there is an RFE?

Please help this is very important to me. Also if anyone have any experience with similar situation please share your experience.

My 2 cents :

1. There is no limit in number of days you stay in India. I went to India using my AP and was there for 7 weeks. I returned last week and there was absolutely no issues during entry.

2. If your 485 is approved while you are in India - you will have ample time to stamp your passport and am sure that should never be a big deal in co-ordinating with your attorney from India or checking your online status frequently.

3. Even for an RFE, the attorney gets enough time to respond. Not to mention that the probability of getting an RFE in 485 stage is really less, you can always co-ordinate with your employer and attorney in case you plan to be in India for an extended time period.

So keep cool and have a nice time in India.
