Questions on Advance Parole renewal

Hi Guys,

I got my Adavance Parole and EAD approvals in August 2002 and I travelled abroad twice using Advance Parole. It is that time again to file for extension of Advance Parole and EAD for me and my family (who knows how many more times we need to file for extension before getting GC approval!!!)..:D

I got doubts regarding columns 14 and 15 in the EAD application (I-765 form). Box 14 says Manner of Last Entry and the Box 15 says Current Immigration Status. I believe, it is Advance Parole to be filled in the Box 14. What should I fill in the box 15? I am still working on H1-B. What should I enter in this column?. I heard that once Advance Parole is used, then the H1-B will automatically be cancelled. Is it true??? If so, what should I fill in this box?

Your suggestions are greatly appreciated.
 
Actually, the current immigration status will be "Adjustment Of Status Applicant". That is what my HR person puts on the forms.

As for H1-B being cancelled when you use AP, I am not too sure about that part. However, you mentioned in your e-mail that you already have EAD card? All you need to do is, see your HR person and fill out the I-9 form. That should take care of it (that is if you are worried about the Status part). Then again, I am not 100% sure about this part.

Thank you very much tshar. This really helps. I will contact my HR department to make sure that I really provide my EAD details. I don't want to work on EAD right now. But if the rule says so, I need to.
 
You certainly are no longer in H1-B status. Whenever you enter the US, you status is written on your I-94. Had you used your (presumably valid) H1-B visa for that, it would have stated H1-B. However, if your AP was shown to the border control officer and you went through a secondary inspection, then the I-94 definitely reads AOS.
 
By the way, don't forget to apply for the EAD renewel too!! As you mentioned you got your last EAD on August 2002, you should already submit for the renewal. It is taking a long time for the VSC to send out the new card.

You are right...

Visa in my Passport has already expired by the time I travel abroad. I got a renewed H1-B approval just a day before my travel. So I used Advance Parole.

Yes, in my I-94 form, they mentioned it as an adjustement of status with my Alien Registration number. Clearly I am in an Adjustment of Status according to I-94.

My HR Department did not ask me to fill a new I-9 form. I received EAD and AP renewal applications from my Comapany's legal department. They mentioned Current Immigration Status as H1-B instead of Adjustment of Status and the manner of last entry as H1-B instead of Advance Parole. It confused me. That is the reason why I posted this.

H1-B is still Valid even after using AP

Just received email from our company Attorney (one of the highly regarded Nonimmigration Lawyer) that the H1-B status is still Valid even after entering US using Advance Parole. This becomes valid until you really use the EAD by chosing open market employment by working for another company for part-time, or you change the existing company and joined another company.

For family, the same holds good. Unless spouse really uses EAD for employment, or the applicant status is Adjustment of Status (uses his EAD for employment), status is still H4.

Just would like to share this information with all these wonderful guys who responds quickly to any posting.

I'll have to ask once again just to make sure I got this right: In this situation you wrote AOS on line 14 (because it's what you have on I-94) and H1b on line 15 (because you're not using EAD to work), is that true?

I am in exactly the same situation and I'd really appreciate your answer.

If you have already used Advance Parole and your immigration status is still H1-B (i.e. you are not working on EAD), then the Box 14: Manner of Last entry should be Advance Parole and Box 15: The Current Immigration Status is H1-B . You can also optionally specify for Box 15 as Adjustment of status. Any one of it is fine. But my Attorney suggested to use H1-B since I am working on H1-B.

AP renewal

I had a question in Part 2 of the form ( I am doing the renewal myself) . I have I-485 pending and is my first renewal .
I am confused between 2 options ( a and d) .
 
Help when filinig Ap renewal

Hi ,
i am filing Ap renewal on my own.I think i have to fill only 1,2,3 ,7 and 8 sections of that form.In 7 th section it says attach a sheet of specifiying ,how i qualify for the advance payrole. what i have to write in that letter.

Being an applicant of adjustment status ,i am eligible for that.can anybody has any letter format can you pl publish here.

I mentioned in my application that i would be temporarily travelling abroad to attend to important family matter.
