Questions on 400N form

Hi all,

I got my GC on Feb12th 2002 and i moved back to dec 05.
I have fullfilled the 3 & 1/2 years of continuous stay in USA of the 5year period and also resided in the state & district for more than 5 years.

I also have a valid rentry permit till dec 07. And I have manged to make my first 6months visit to full fill citizenship residency jun06. Now that all this info is out there i have a few questions on 400-N and general naturalization process.

1. The 4 years 9months time that I can submit the 400-N form is that counted from the date of Feb12th, 2002 irrespective of # of months i was out of the country if I fullfilled residency and physical presense? Meaning is it only calender year/month based count?

2. In the part2 of the form (information about your eligibility)if I am applying in 4yrs 9months then I need to specifically explain that in the other box right? Because I don't see that option in the list.

3. Are the fees $400.0?

4.My current address in that case should be Indian address right? I have a mailing address for them in USA but residence address is going to be India in the Home address section? Has anyone gone through this process after moving back to India?

5.And I am currently working for an LA based company in India so I do need to give my India company address in the location where i have worked in the last 5 years right?

6. Do we need to give information on all driving tickets I received in the duration of my stay in USA?

Appreciate your help in this matter. I am sorry if the questions are trivial but I just don't want to goofup in this.

As long as you were not out continuously for more than 6 months at any given time, you can apply 90 days before completing 5 years. You got your GC on 2/12/02. That means you complete 5 years on 2/12/07. If you subtract 90 days, Nov 14, 2006 is the date you will be eligible to apply.

You have to say you are apply under 5 years rule. 90 days is just the cushion they give.

I don't know the details of the process of applying when you live outside of the country. I thought, you have to have a US address. But I could very well be wrong.

Same applies as written for question 5.

Not necessary. But does not hurt.
 
I'm pretty certain giving an overseas address would hurt your chances of naturalization - after all, you are claiming to be a US resident... At the very least I think it opens the door for some pretty stiff questioning.
 
Yes, I'm pretty sure that if you refer to your residence in the US as a "stay" and you get your mail in India, the USCIS will take a dim view of your commitment to the US.

Hi all

Just to follow up on couple of comments that came out of the thread....I do stay in India but while in USA I stay at my sister's residence. So I can give that as my home address but in the list of address that i have to give in the last 5 years, I will have to give atleast one of my India's address as its very clear from the form that I am outside India currently. I can't deny that anyhow, so can't hide that info.

I am now confused about what to do.....

But do thank you all for rest of the answers...I love this forum :)
