Hi All,

I am new to this forum, and had a couple of questions.
I am using a substitute labor.
At what stage would i know whether the labor that has been used is authentic? I mean, it has not been used prior to my application for anybody else, and that the original labor has actually been sent? Would i know that the labor is okay if the EAD is approved?
Also, Is it possible to verify the category of processing (EB2 or EB3) after the case has been filed (if the company refuses to mention it)?

Applying without the original labor is not a problem in itself

It may take a little bit longer as USCIS will find the I140 application which has the original labor and attach the labor cert to your 140 application. My 140 has been filed with a copy of the labor certification and a copy of the withdrawal letter which asked INS to revoke the original I140 petition. I got EAD and AP within a month. So approval of EAD does not signify anything.
