Questions for filing Family-based AOS while employment-based AOS is pending

Hi, everyone,

I recently got married to a US citizen and would like to file family-based 485 while employee-based AOS is pending(EB3, 485 Receipt date: 8/22/2007, Label Priority Date: 10/2005).

When filling out the form 485, I have a few questions I hope you could help.

1) What should I put for "Current USCIS status". I changed jobs not long ago and am using EAD to work. Last entered on Advance Parole on 05/2009. Could you advise?

2) on Page 2, Part 3. Processing Information, what should I put for "In what status did you last enter"?

3) in the same section, it asks Nonimmigrant visa number, Consulate where visa was issued and date visa was issued. I do not know what I should put in there. My last two entries 2008, 2009 both used AP, H1B extension approved on 11/2008 but never used for entering. The very last time I used for H1b to enter was back in 2005.

For both of your questions - I think the answer should be :

Current status: "Parolee status"
Last entered: "Parolee status"

But please make sure check with other posts or with a lawyer.
