lawyers when they help on replying RFEs to BCIS, do they bill separately for that time spent or that is usually comes as part of the gc application's entire package? Has anyone experienced anything on this? My company is no longer is paying lawyers' fee now and the lawyer represents me. In case of rfe, do they charge
extra for that portion? I am just trying to see general practice and can depend from lawyer to lawyer.
 
My personal opinion is that time spent on responding to RFEs is part of the parcel of services forming the green card process. Obviously you need to review the contract with the lawyer, if there is one.

My lawyer has never shied away from working on any ancilliary issues relating to the green card process and/or H1 renewal. It pays to act on the assumption that all such services are included in the contract and have been paid for; in other words, demand for and take such services for granted. If the lawyer protests or raises a demand for payment, negotiate.
 
Here is what happend to me ..

My EAD is going to expire in about 110 days , so I called the lawyer saying that I want to re-apply for my EAD ASAP , so that if need be I can utilize the 90 day rule and go to my local INS/BCIS office.

The para-legal said it was a good idea , but they will charge $150 in legal fees to file for my EAD. I guess, I'll file for my EAD myself, but it just shows one's ethics.

If I get an RFE , I guess the lawyer will again use it as an oppurtunity to make some more money. :mad:

I guess its best to grin and bear it ..
 
most lawyers will only include the price of filing one EAD and one AP along with the initial I-485 application. The subsequent EADs and APs are in no way connected to your GC and therefore they are considered extra charges.

But an immigration based rfe, i got one in the labor level and one in the AOS level, are part of the money you pay a lawyer and I was not charged for either. Actually, if i was asked to come in for a face to face interview, my lawyer would have accompanied me free of charge.
 
I didn't pay my lawyer for my RFE and usually no lawyer charge for RFE. RFE like any cases of denial is part of their fee and lawyer usually not be paid for these extra services.
Make sure you check the agreement between your lawyer and company. May be this is not the case in your filing.
 
My lawyer does charge for responding to the RFEs.

I think this depends from lawyer to lawyer and also as to what
was included in the original package (if there was one). In my case there was a separate charge for every step and hence there
was no concept of a package.

According to my attorney, for a second EAD and AP applications, I have to pay. If I use AC-21 and change the company, the attorney is not going to represent my case, unless I sign a new document with them and pay their fee.
The attorney was very clear, as long as I donot use AC-21, or my company does not change their attorneys, any RFE would be taken care by them without out any additional fee.

The last sentence is what related to Gheewalabhai's original concern. But also it depends on attorney to attorney. After One year of I-485 application pending, even my attorney may change their words/sentences............ who knows.
