I had filed my I-140 petition based on National interest waiverand EB1. NIW petition was approved. I work as environmental engineer. I have the following questions and would appreciate some answers
I had also filed I-140 based on EB1 which was denied earlier. After that I had filed my NIW , and on getting receipt notices of both I-140s I filed I-485.
My I-485 was denied because earlier filed I-140 was denied. I submitted Motion to reopen for both me an my wife, attaching evidence that I had one more I-140 pending.Questions
1) After how much time I will know whether my I-485 will be reopened.
2) Do I need to file another I-485 if i do not hear about MTR.
3) I also have a misdemeanor on my record. My case will most likely be called for interview. it has been four years that I have travelled home, if I go abroad on advance parol, will I have problems on reentry? I will have petty offense exception because maximumpenalty was 6 months.
i would appreciate responses or if someone has had experience with POE with a misdemeanor.

Replied with one more letter and NIW approved last week August 2005.
