Questions about F1 visa status while I-485 is in pending

Hi all,

Here is the situation and we do appreciate some advises.

I am a citizen and my wife is a student with F1 visa. We filed I-130 and I-485 together last Nov., and we went to the interview on 3/1/10. Everything seemed smoothly we've only been in the office about 10 minutes without being asked any personal question; however, we got a letter from the service this week.

My wife used to be a student before we got married in TX (school A - Jun, 2008 ~ Aug. 2009). After we married six months later, she moved to CT with me. She also transferred to here (school B - Aug. 2009 ~ Mar. 1st, 2010).

Here are what we got in our hand. She got her working permit (I-785 i think), and I-130 approved. Here is the question. We went to the interview on 3/1, and it was also the date her school period ended (it was a 10 weeks program cycling). The immigration services asked for a letter from my wife's school (school A in TX) to indicate she was a student in that school. It did not mention about the second school. Question are a) do we still need to maintain student visa which means registering another school period to keep F-1 visa valid and b) do we need to submit related documentation about school B or just what they asked for?

Really appreciate someone can help. Thanks

School A was the one through which she got the F1 visa to initially enter the US. So I think they just want to verify that she actually attended that school for some time after entering with the visa (that she did not commit visa fraud).

Info for only school A was requested, so only provide the documentation for school A to prove that she attended there from June 2008 to Aug 2009.

Did she get a new I-20 for school B?

Thanks for respond

She has new I-20 from school B for now; however, the school told us if we did not register the next program, they will terminate the I-20. Do we still need that?

No, at this point she doesn't need to maintain the validity of the I-20 from school B. The point is that she got it, so if needed she can show that she was doing things the right way.

She should go to the International Student Office (or whatever they call it) at the current school and present the I-485 receipt and ask them to update her status in the system to reflect her pending green card. That will remove her from SEVIS monitoring, which she doesn't need now that she has a pending I-485 which makes it legal for her to study without an I-20 or F-1.

Sounds kind of relief.

One last thing. Is it better to make an info pass appointment to submit the supplement document instead of mailing it to the service?

Great thanks to Jackolantern.
