I am a U.S. born citizen who has been living in Costa Rica for 14 years. I have been married to a Costa Rican for 12. The marriage was in CR. I have residency there. We have a 7 year old son together who is a U.S. citizen as well. My wife is on her 2nd b1/b2 10 yr visa with about 8 years left on the visa. She has traveled back and forth to the states with me at least 12 times. To be honest I have sort of been under the radar not having filed taxes for 14 years, young and stupid. I was always outside the states for longer then 11 months so filing back taxes shouldn't be a problem. Well this year I grew up a little and thought I might like to give the states another chance. I interviewed for some jobs while on vacation last month and received an offer. My employer down here gave me an open door to come back if things don't work out. We also own a house down here which is in both our names. I will be going up in a couple of weeks then hopefully my son and wife will join me in 3 weeks while he has a 2 month vacation. My wife will enter on her b1/b2 visa and my son with his U.S. passport. She usually gets a six month entry. I have no idea whether he, she and I will enjoy being back in the states and how things will go with the new job. There is a 90 day probation period on the job. If the job turns out well and we all agree that living in the states is good for us and we find a school for my son can my wife apply for a green card while in the states on her visa. Like I said we really have no idea right now if we want to permanately be in the states but if after three months we realize we do I may have a hard time leaving a new job to start the green card process in CR and I definately would not want to be seperated from my wife during the process. I certainly don't want to be seperate from my wife and son but don't know how I could take care of him and work a new job. Any answers and suggestions would be greatly appreciated.
