My 140 is approved and 485 is been pending for more than 180 days.
I am already on H1b 7th year extension. I have EAD and my wife also has an EAD.
I am being laid of and my last day with my current employer is Dec 31st, 2004. I will be working to a new employer beginning Jan 1st.
My Question:
1) Can my new employer file my 8th year extension of my H1B??( I can use my EAD, but I want to stay on H1B.)
2)If in case my 485 is denied, is my wife 485 will also be denied or she is independent of my case.
