The denial of cp can only happen for very few reasons.
a) Lack of some documents:- This is not denial. In this case
the candidate is told to come back with the required papers
and he/ she should be able to come back to US if necessary.
b) Outright denial (rejection) :- a) Can be due to mis-representation of facts . b) Some communicable diseases .
In these cases I believe the candidate will not be allowed to
enter the US.Because his present VISA would be cancelled too.
If your question is,
Can I pursue my AOS process even after my visa has been denied at the Consulate, then the answer would be No!
I think your's has to be AC I-140 (type of CP) since you claim to have a pending AOS. If you had opted for CP at the time of I-140 filing only then it would be the regular CP. But sicne you opted for 485 at I-140 filing and now you have changed your mind, it is AC I-140. Anyways...
