Question Urgent: please help

Hi,

I just found out that my project is ending in the next 2 weeks. Since I dont' expect to find anything till Jan, I have decided to go to India for a vacation. My first AP expired on Nov18th. I filed my Second AP RD Oct22, 03. My H-1 is exipiring on Jan 1, 2004. Although the H-1 Visa stamp on my passport is till May 2005.

Can I walk in to the NY Federal plaza office and get an AP. If yes, how long will it take. What questions might be asked. what do i need to take with me.. Please help. I need to get tickets issued by Monday to make this trip.

If you have valid H-1 visa stamp, what the hell you are bothering about? Why you need AP?

Also how come your H1 expires Jan,04 and visa valid till May,05?

Go to NY JFK airport, not to NY Plaza.

Start using EAD now. Hope that AP gets approved by Dec'31. Goto India after AP approval. Good Luck.
 
Here's the issue

z/OS V1.4,

I have valid Visa Stamp, however my H-1 approval notice is expiring on Jan 1, 2004. I know they may not ask me to show the approval copy as long as i have the stamp but technically past Jan 1, i would be working on EAD so its kinda illegal to enter on H-1.

how come my H1 expires Jan,04 and visa valid till May,05.
==Don't ask me. i was given a 5yr visa stamp when my H-1 was only valid for another 2 yrs.( of course i didn't complain). changed employer but couldn't get another stamp coz the previous one was still valid.

I would go to JFK, just want to make sure i'm not doing anything wrong coz when I come back i'll be working on EAD. I am not filing for H-1 extenstion. my I-485 RD is sept04, 02. btw I have signed the petition and also urged my friends to do so.

You have suggested waiting till Dec 31 to see if i get AP approved, this is my second AP, IS it at all possible to get it from NY same day.

On AP receipt notice, nowadays it says 60 days. But if you call any IIO, they say 90 days. So you can try for interim AP after 60 or 90 days.

There is no rule that local INS office has to issue interim AP after 60 or 90 days of RD of AP. It's your luck and depends on the reason. If you are nearby NY office, try one or more times. No harm in that. It's your time, energy, and money.

Also your luck. Prepare to tell valid and solid reason. Just imagine in their shoes for sometime, and see what kind of reason and documents will convince you. Give a try.

If your 485 and AP are pending at NY office, rather than VSC, then more chance of getting interim AP at NY office. Not sure how many people tried and succeeded.

Plz verify, But i have heard that it is not a good idea, to go out of the country when AP application is pending. So, u should atleast get an emergency AP. I don't know, if u can get regular AP from local office prior to 60/90 days of application.
Anyway, wait for other responses as well.

The local BCIS offices will issue AP on the same day if you are able to convince them that there is an urgency. But they won't give you same day AP if you say that you have to go for vacation urgently.
 
NY AP experience

I went to Federal Plaza in New York today to get an AP, after 2 interviews and hours of wait I was denied.
