Question : Urgent : h1 7th year ext.

This question is from a friend. His company is trying to do a 7th year extension for one his employees. I am posting his question.

"'We have not received a Receipt Notice for a Labor Petition we had filed back in 2002. Now we have to file a H1 extension (7th year) for the beneficiary for which the Receipt or some acknowledgement from DOL, NJ is required. The attorney has been sitting on this for over 2 months. Is there some way one can get this info directly from DOL, NJ either by email or thru their website?'

As I understand, NJ doesn't send any recipts to lawyer for LC submission. Your lawyer will have a recipt from FedEx or USPS about the LC document sent to the NJ SESA. That recipt is good enough.

you can use that recipt + letter explaining this situation to extend the 7th year H1B.

Part of the problem is that the lawyer has been a pain. Not being helpful. So apart from the Fedex/usps rcpt there is nothing else is it ?

One of my friend also did the same, as advised by his attorney few weeks back but got RFE from NJ, asking to submit the receipt from labor department.

The attorney had to request DOL NJ for proof of submission, which took about 2 weeks to get.

The 7th year extension was approved after submitting the proof.

how much Time?

Do u know how time it took for the approval. Mine is also the same case and my attorney has sent the supporting documents, but mine was motion to reconsider. So did ur petiton was actually denied by INS or did they send you query?
My petiton was denied as they have sent the postal confirmation receipt and said in the notice that i have 30 days to apply for a motion to consider with 30 days of time... My attorney was supportive and he got the DOL letters from both Regional as well as State DOL. Please tell me how many days it took for you for the approval after submitting the supporting documents? My friend's case was premium processing. He got RFE, not the denial.

His case was approved in less than a week after submitting the letter from DOL.
