You really don't have to give any reasons for extreme hardship. It is at the consulates discretion.
They are basically looking at the original 824 receipt and making the decision.

I have opted for AOS at the time of I-140, now looking at the time frames for AOS, AC-140 looks more lucrative.

This is my understanding of the sequence of events that needs to be done for AC-140, please correct me if im wrong.

1. File I-824.
2. With the I-824 receipt, send the packet3 information to the consulate. (Mumbai)
3. From the post that i have read, Mumbai does accept AC-140 application. Now the question is what happens if they refuse it?.

Can we revert back to AOS?. Or would it be a good idea not to file for AOS and just file for I-824 and wait and watch.

Once the consulate receives the I-824 receipt along with the I-140 information, how long does it take for the intervire date?. Would 4 months be an optimistic target?.

As long as you have at least one previous visa issued from Mumbai, they will not refuse it, you don't even need to provide any "hardship' reason.

Don't file the AOS. Waste of time and good money. I made this mistake. Just do the 824 and the AC140

4 months would be a pessimistic target. The consulate received my papers on Sept 3. Oct 28 was my interview.

Thanks a lot for the answers.

Could also please let me know what papers do we need to submit along with the I-824 receipt.
My lawyer is not very co-operative since we have all the paperwork ready for AOS and he wants to stick to it.
