Hi guys

I received my nonc pro tunc appointment to Agust 1st. I am so scare about it. They request me so many documents about me and my case. I would like some advice from you, guys. and I have a question, they say that the reazon of my appointment is Application for Ajustment of Status, I though maybe will be for I 589. In your appointment letter the reason was the same like me?....

They say on the letter that do not bring small children to the interview unless there is a specific applicnat filed for them. In my case I put my family, (wife, and children) on the application I-589. But they are Resident holder and american citizen. Do you think I need to bring them to the interview?

Congratulations: You are step close to your greencard: I don’t know really know why you are doing your nunc pro tunc; for example, whether it is age out or divorce. However, the process is simple, and each IO is different. But what you will need is gather all the information you have. For example, you nunc pro tunc is based on divorce, get the original divorce certificate, your original I-94, your original asylum approval and perhaps your state ID. Get all the paper work you can think of or you have in your possession. In my case, the immigration officer asked me my ID, he copied my I-94 and returned it to me, he asked how I got my asylum and I told him that I got it through my wife, he asked me her name, and then he asked me about address and that was about it. He did not tell me whether he approved me or not. But he demanded that I get him my original divorce certificate which got him within hours. In about week, I got an approval notice through the post. I mailed the approval notice to Nebraska service center and within two months I got my green card approval…

About the family you included in your application; they have nothing to do with you unless you have listed them as your dependents and you want them to get derivative asylum status, which they can’t get through you unless you abandon you nunc pro tunc. Normally, the asylum application has two sections; one section you list those relatives that you want to include your application; the other section is for relatives who are your relatives but you do not want to include your application; and it is this last section where you are supposed to put you green card and citizen relatives. Your relatives do not need to go with you. They have nothing to with you. If you listed them the dependent section, then that is mistake and you should tell the IO about the status of those people…

As for you question that your appointment letter says interview is for adjustment status. I am sure of that. Mine said clearly interview is for asylum. I think one think that will clarify this who is sending the appointment; asylum office or USCIS. If the appointment is from asylum office then it is for nunc pro tunc; asylum office do not have the authority to issue or approve greencards, but if the interview is from USCIS then it is for greencard as the uscis do not have authority to do nunc pro tunc. In each case, get ready and good lucky, and don’t be afraid…it is easy and you will win…and do not miss the appointment. That is the worst thing to do….
 
Mr.Jupiste; I saw one of your old posts that you divorced the principal and remarried. If this is the case, then the situation is little bit complicated. Have you told them about your remarriage, or do you have a divorce and remarriage certificate? Also, who is sending your appointment. Asylum office or USCIS? You might be lucky and your interview is coming from USCIS and you will get your green card...Make sure you have marriage and divorce certificates. they are very important.

Yes I did, I was divorced and remarriged with the pprincipal. I know my case is complicated. I told them in my Nunc pro tunc aplication my reasons for my divorce and remarrige. I have my divorced and remarried certificated. For this reason, I think that I need to go with my wife and kids ( actually, my last kid born one month ago). I don't know who exactly sent me the letter appopintment, this one appear form the local office. How do i know who send me the letter (asylum office or USCIS)?. I have another problem, I did my taxes alone, because , I remarriged on dicember.. Do you think I will have problems with that?

In my case, there was no talk about tax return at all. And I don't think that it should be an issue. And by the way, I think married couples can file their tax return jointly or separately, that shouldn't be an issue.

The question of who sent you the appointment letter should be clear on the envolope address. They should put their address on it, and that should tell you. It should say asylum office or USCIS office.

Regarding your family, if the appointment is from asylum office and your family citizens and greencard holders, then you don't need them, but if it is from uscis you may wanna take them with you. In each case, your family is your family. It is good to have them in lobby while you are in process, but I don't think they will be needed. Any way keep us update on your experience and how things go. It is scary, but it is really easy unless you have something stupid in your record, like murder, rape, etc....Good luck

I am going to check my envelope address when I arrive to my house.
I don't have any criminal record in my life.
Anyway, I will prepare everything, and myself for any situation in my interview.

I will update my experience with you guys.
