Question regarding "Volunteer" Position

Hello Rajiv:

My OPT expires in the end of June. I am currently working in a company under OPT and the company would like to sponsor my H1B. Since my H1B could start only from October 1, 2006, could I work as a "Volunteer" without pay and benefits in the same company till Oct 1 and then become a full time employee?

I heard from my friend who applied as a Volunteer that USCIS raised a query regarding proof of legal status during his Volunteer period. Is there any way to get proof of legal status for this three month period (July-Sep)? Is there any official website detailing the procedure?

After OPT grace period expiry, you must have a valid visa status like visitor visa etc. to ensure proper status.

Else, it may be a good idea to leave country and return 10 days before start of H visa.
