Question regarding using advance parole (AP) on h1b visa

I received AP and planning to visit India in November. Do I loose my H1B status if I use AP? Can I keep Advance Parole for emergency use and get visa stamp in India?

My 140 is still pending what option I have in case when I am in India 140 get rejected or get RFE?

i am almost positive that once u use your AP, you loose your H1b status - you cant have both.

if you have 140 RFE that require your signature or documents, then your only option is to carry all documents with you and send them to your lawyer by the date on the RFE - some people have been asked to reply within 72 hrs...

if your 140 gets rejected, you can appeal, but that is only if dont use your AP...

you will not losse your H1-b status

I am in the same boat my I-140 and I-485 are pending and i have AP and EAD i asked my lawyer about this and he said one can only loose h-1b Status if you use EAD with same emplyer you are on H1-b ,so if you travelling its best to use AP and keep you H1-b Approval with you. but dont use EAD till you get approved .
