yes Ive read on several sites that if you travel outside of the country during your aos period and you have been out of status for a period of time that you might not be able to come back to the country...

one thing i want to know is if anyone on here has traveled outside the country with ap after being out of status for a period of time and if so what did lawyers tell you and also did you have any problems getting back

another question i have is.. ok if you had a legally permenant resident (your mother) file for you right after your visa expired will they still count those days that you have been waiting for the papers from that as an out of status period of time? or would they take in consideration that you have been waiting on your documents

If you have been out of status then you might have problems and you need to get legal advice on how long can you be out of status to be admissible with AP.

I understand that but what Im not sure of is.. say if you had someone that filed a petition for relative for you right after you became out of status.. would your status be changed from out of status to case pending?

Ap

If you were in an overstay of more than 6 months prior to filing your advanced parole, USCIS may still issue it, but do not use it. You will not be let back in and your application may be considered abandon.

The rule for priority dates says you are still ecruing unlawful status while waiting approval, that will only effect you if the petition/applciation is eventually denied. If it is approved no problems.

If you have unauthorized presence of more than 180 days, applying for AP is an absolute waste of time and money. AP does not waive the mandatory 3/10 bars so if you leave the US you will not be readmitted and AP does not change that situation.
