Hello All,

I have filed for my I-140 and 485 concurrently from NSC in Oct 2004 under EB2 category. We have our fingerprinting done and have also received the EAD for myself and my wife. My question, is my case going to be affected with the new rule for retrogression ??

Please advise

Swapnil,
yeah.. the others are right. You should be fine for now. I filed my 140/485 in Oct2004 under EB3. I'm affected my retrogression as I'm from India. Post your RD/ND etc.

I am using a pre-approved labor from May, 2001 (EB3).
And I filed my I140/485 in Dec, 2004 with ND of Jan 7th, 2005. Will I be affected by retrogression?

Thanks,

No. Its not approved yet.

I am confused by how the I140s are processed. Do they get processed by the notice date of I140 or the date when the original labor was applied?

Thanks,
