Question regarding filing I-485

Myself and my spouse got our Labor Certificates cleared. We are planning to file I-140/I-485 concurrently through both the companies...I mean, my spouse will be filing me as a dependent and I will be filing my spouse as dependent.

1. Is there any advantage by filing 2 I-485s?

2. Regarding medical examination, can I get 2 sets of sealed envelops from doctors to send it to two different lawyers, since I am filing 2 I-485s?

Thanks

2 485s are confusion..

as per murthy discussion she mentioned once that filing 2 485s can be confusion for USCIS and useless for the applicants. You should file one 140/485 and other 140 with CP option and then whichever comes first take that.

If 140 with CP option is approved, you can do attorney certified CP in some consultates in India.

find out more about the CP option before filing.

Re: 2 485s are confusion..

Read somewhere in the forum that we can file 2 485s and it has to be done in the following order.

1. File 140/485 thru your LC for both you and your spouse. Wait to get the receipts and Alien Numbers.
2. Then file 140/485 thru your spouse's LC. Mention your A#s in the forms and submit.
3. When one petition gets approved withdraw the other pending 485.

This is a safe bet. But there are some questions still unanswered, like what abt the EAD and AP's? Do we have to apply 2 EAD and APs? If we had to use EAD, then which one to use and what if the respective petition gets denied etc.

As will_get_there suggested, CP option for one is also good.

..

Thanks a lot for the advice.

Adding to the question...

I filed my I-140 already without I-485. It is not approved yet. Can I change it to CP at this stage. If so, can someone give me a headstart regarding the process.

Thanks..

Re: ..

When I filed my 140 lawyer said it is always easy to convert the CP option to AOS. The other way round takes time, but it is possible. You can consult a good lawyer on this.
