Question regarding AP & EAD renewal

Hi All,

I have applied for my AP & EAD renewal in Dec. My AP is approved and EAD is pending. But I haven't applied for my wife's AP & EAD renewal. Her AP will expire on end of Feb and EAD on May. I would like to renew her AP & EAD myself.

Do I need to send the copy of I-94? We wend to India last Dec and our I-94 says that AP expires on Feb. Is there a problem with this date?

I am sure, they will look into the EAD application only after 3-4 months. By that time I-94 date will expire!!!!

Please advice..

Thanks,

i485Jan.

If your wife entered US with AP lastime, then there is NO
expiry date for I-94. Don't be bothered what was written in I-94.
Some INS officers don't understand AP thing very well (for my wife
at LAX one INS officer didn't know what do with that piece of paper, so he called his supervisor).
As your wife's I-485 is pending, no matter what I-94 says or
when EAD card or AP expires, your wife is always in legal status.

For renewal of AP and EAD you need to send copies of I-94 - front
and back - both sides.

There is no relation between I-94 and EAD card. It's not
mandatory to have an EAD card. If your wife is not planning to
to work in future, it's waste of money to renew EAD card. But
having an EAD card always gives flexibility as anytimes she
can take up any job offer, if she likes or such a situation arrives.

But it's always recommaned to keep a valid AP even if you
don't plan to go abroad in near future. It becomes handy for
any emergency situation - if your family members or relatives
living in another country.
