Hi there peeps, Good day to all.

Today, I just had my biometrics code 3 and went well but I've been wondering about the advance parole...who qualifies for it?

I'm asking because I'm thinking of getting one once our interview goes through(if i qualify). It will depend on the answer I'll get from people who know about this.

My husband sponsored me but I've overstayed for more than a year. I was on a B1 visa and I-94 had expired too when we filed the application.

any input will be much appreciated.
 
You qualify for an I-131 because you are applying for Adjustment of Status.

However, because of your overstay if you leave the country. You are subject to a 10 year ban from returning to the USA and your petition will be denied at the interview.

Under no circumstance you should leave the US before you get your GC. Do not worry, in about 5 months you should have it and be able to travel/work/etc.

so it means i can qualify for AP once i have the GC?

Once you get approved for your Gc be it 2 years temporary or 10 years, you are free to travel to anywhere you want....
so you will no need the advance parole document or 1-131 aproval anymore.
so sty put prepare for your interview and you will be able to travel all you want...lol..

Now, almost everything is falling into place.

I have my EAD approved and now, just waiting for the AOS interview schedule from INS.
It might take a bit longer but I hope it's worth a wait. lol
I've been reading a lot of guides for the interview process but we have lawyer who will brief us a week or 2 before the interview.

And btw, I'm a girl. hehehe
