My I140 has been approved and I am presently waiting for the dates to
become current so that I can file for I485. However my H1B six year limit
is set to expire by May 1, 2001. My attorney is getting all the paperwork
ready to file for an extension as per S2045 rule. Here is my question:
My attorney says that if the extension is not approved before May 1, then
I will have to stop working. Is this true ? I thought that as long as the
application for extension is filed before the expiration date, one is will
be allowed to work for 240 days or until the outcome of the application
process is known. Am I right or is the attorney right ?
