Question: Petition for Sister and Affidavit of Support

Hi!

I will be a USC next year and I'm planning to sponsor my sister (18 years old at the moment) for a green card.
The problem is that I currently don't have a job/not working because my husband told me not to work.

Questions:

1. I am aware that I need to prove that I can support my sister at 125% above the mandated poverty line, by filling out an Affidavit of Support. However, since I'm not working and obviously doesn't have any income, can I still sponsor for my sister? If not, could my husband help in some way? Since he made about $3,000/month I think he can support both myself and my sister.

2. Once I filed for all the stuff needed to sponsor her, could she apply for university while she's waiting for her green card? Does she get social security number?

Thanks in advance!

You only need to provide the Affidavit of Support when she reaches the stage of filing papers for the consular interview or adjustment of status, which would be over 10 years from now. So you have plenty of time to find a job. If you still don't have enough income at that time, your husband can file I-864A (along with the I-864 you would file) to combine his income with yours.

He TOLD you not to work? Is he a Taliban?

Does it always take about 10 years to get a green card? One of my friend got it in 2 years through the same process.
Well, I forgot to tell you I have kids and that's why my husband told me not to work.

P.S. - No, he is not Taliban.

The length of time varies widely depending on the path taken. With marriage to a US citizen, it's as quick as 3 months. But for siblings it takes longer than 10 years.
