My Employer has applied for a H1-B visa on the 24th of September 2004 at the California Service centre (For FY2005). The employer has since notified me that the Fedex receipt says the USCIS (CA centre) has received it on the 25th of Septemeber 2004. We have not yet received a WAC# which is a receipt number I think.
1.How long does it take to receive a WAC# from the time the Processing centre receives the application?
a.(Just wondering) If WAC# is just a receipt of the application without any other checks why the delay in issuing a receipt number?
2.The USCIS has said that the FY2005 Cap has reached. Is the Cap the number of applications that USCIS will receive or is it the number of applications successfuly processed?
a.If it is the number of applications that is sucsfuly processed then, does it mean that all the applications which have been received might not be looked into if say some where mid way the total number of applications succsfuly processed has reached the Cap figure? Or does it mean that all the applications which USCIS receive upto Oct 1 2005 will be processed and the ones which are not declined are all considered to be inside the cap even though the total number might be more than the Cap figure?
