Question on Substitution LC

Hi,

I recently joined Company X and company Y is doing my Substitution LC. At the time of filing for I 140 , I am planning to opt for Consular Processing.

Do I need to be employee of company Y at the Consular processing interview ?

Legally no. However it is accepted practice to get on pay-roll. Post your query in CP thread. You will get advices from people who have undergone CP or intend to undergo one.
 
Substitution LC

How can somebody do a sustitution LC? I am changing employers, Company A has filed for my LC 3 yrs ago, Company B is filing for another H1B, and planning to file for GC as well, LC has not been approved yet. Will it be better to do a substitution LC since both companies are in the same industry? What will I need to do?
