Question On spouse 485..?

MY Gc is apporved and received the card. Waiting on my wife's case. As my employer is sqeezing money from me for four years and I am bearing the lawyer charges and now thought of leaving him. I told him that I am planning to leave. He told me that he will get back to me if he can offer more salary.

Meanwhile, my sister's marriage is fixed and leaving to india on Feb4th.

I am thinking now to leave him after I come back from india. Still my wife's case is represented by my company lawyer.

So Now i am thinking, If my wife get any RFE. Will it come to me/wife or will it goto company lawyer. If I get acopy i can reply to it. If not my company owner may give some troubles to me.

I am little worried evern after I get my GC/. Please advise me. Pelase reply me.

hire your own lawyer. Change theG-28 (or whatever number for lawyer presenatation form). !-485 is her petition so you will get an update. but best to have your own lawyer. wont be expensive as most paperwork has already been done.

I am in a similar situation...Do you know if we have any dependence on our employer for spouse GC. Specifically could USCIS ask as to furnish I-140 approval copy etc at any stage..My company never shared that with me...
 
As far as I know any notice related to your wife's case will be sent to the Lawyer representing her case (i.e. whoever was specified on the G28 filed on behalf of her) except the duplicate approval notice.

You definitely can file another G28 to change the lawyer or represent yourself for your case, but in my case (my company switched law firms) even though the new lawyer filed the G28, all the notices have been sent to the old lawyer (this is how efficient USCIS is).

I had the same issue related to my case being approved and my spouse's case delayed. Finally it turned out to be that USCIS wanted to see if we are really married (my wife did not have her last name changed on her passport) or not and requested for a copy of the marriage cert. Once we responded with the cert, USCIS did approve her case within 4 days (I was really impressed).

I understand your worry, but I think that once the primary case has been approved, it should not be a issue with the dependent case unless the dependent has any status related issue with their stay in the US or something like that. It might just be that they want additional information about your dependent.

Please note that I am not giving you any adivse but just sharing my thoughts.

Unless there is any specific issue with your spouse's case, dont worry about hiring a lawyer now. Be in touch with your exisiting lawyer and try to maintain good contacts with your company/lawyer.
Thats what i've been doing. My wife recently got her FP notice and it went to my previous attorney (with ex-employer). They promptly forwarded it to me.
