Question on L1...

Hi,

I am presently working for a company X and i have valid L1 visa till April 2008 and my I94 is valid till April 2008.

Another company Y has agreed to process H1B for me and i have given them all the paper works requested by them, and they are going to do Premium processing.

I have planned to visit india for some personal reason (Need to be there by May 26 2007), now i am not sure if H1b will get approved by that time.

What will happen to my H1b if i come back to US on June 23 2007 with my L1B visa, will Immigration use my existing I94 to process H1?

Will my H1b gets cancelled, if i come back to us with my valid L1b?

your answers will help me to plan the india trip.

If you applied for COS (change of status) then its a problem. If you applied for regular H1 - no issues. If COS is approved before you return, per last action rule you will be on L1 and not H1...
