You should never lie on your form. If you were arrested, you must state YES. I know someone who applied for an H1 visa and on his form he stated that he was arrested. Initially his application was kept pending results of fingerprints. Once they verified that all charges had been dismissed his visa was granted. I am not sure about the second section, you may want to consult your criminal lawyer on this one. Good luck!
