Here is a scenario. Please advise
One of my friend had his GC filed through Future Employment. He had never worked for the company who filed his GC. He has EAD, AP, FP done, 140 approved and 485 pending for more than 1.5 years.
Does he need to really work for his future employer? His future employer is asking him to join him now but is trying to take more money from his billing and my friend doesnt want to pay him that high rate.
He has paid all the money for his GC upfront and he doesnt want to join his future company.
He has read in some forums where AC21 clearly says that one doesnt need to join his employer even in case of future employment as his employer(future), should be in a position to hire him at the time of 140 approval. His 140 is almost 1 yr old after approval.
My friend is in a dilemma whether to join him or to keep working for his client though his another employer.
