I entered US using H1 visa from company A and got an offer from company B within the first weeks of my arrival. I never joined company A and started with company B upon receiving my H1 notice that was filed for company B. The receipt notice was dated 33 days after I entered US.
I have changed jobs 4 times after that and all subsequent H1 petitions were approved. I am preparing to file for I-485 now and my company’s attorney is concerned about the first H1 transfer that I had since I never worked for company A. The attorney suggests that I re-enter US using my H1 visa but this is not an option for me since I would need a new H1 visa stamp to re-enter and that could take long.
Does anyone know if switching to company B without working for company A could be a problem for I-485 approval? And what the solution could be?
Does anyone know which forum I have to explore to find out about similar cases?
