Question on EAD

If a person is working on EAD and forgot to renew his EAD application and suppose his EAD is expiring in next 10 days, what are the possibilities to continue his employment.

He does have a receipt notice for filing EAD? What are the possiblities, is there a way for INS to track the employee to see if he is still working on EAD??

There is no possibility to work. The person should stop working until he either gets his approved EAD or he gets an Interim EAD. This is this persons fault. I hope that person is not you.

Its not me.. But can INS track to see if the person continues employment after EAD expiration??

Would that affect I485 approval???

His employer is supposed to track this.

I dont think anyone tracks. But they can track. Also it does not mean that there is no risk. Ideally it is the employers responsibility that they should note your EAD expiration date and demand a new EAD when it expires to continue employment. But most employers dont do this. Still, if I were this person, I would not take this risk and continue working. This thing may haunt you all the way to citizenship. Doing something illegal is at the end of the day, illegal. :D

dazzling: How long does EAD take and how much does it cost? Is it valid for one year only? IC
 
I guess EAD cost $190 for now and it takes anywhere between 90-120 days maximum, else you can get your interim EAD after 90 days at your Local INS office provided there is no RFE on your I140...

want_gc_soon has already answered your question. The only thing is that the validity of EAD is one year now but is likely to be extended .. lets hope and pray it does get extended ... soon...!!!!!! I mean they have passed the memo / resolution which allows them to issue EAD for more than 1 year, but they have not yet implemented it.

Now where did you see the EAD filing fee to be $190??? As far as I know if it $175, at least that's what the USCIS forms website tells. Pls confirm. I am filing my EAD today and don't want surprises.

If the INS forms say its $175, then it should be $175, thats the reason why I mentioned,( I guess $190)..

I checked it again and the website says $175 for EAD and $165 for AP. Hope it helps!

Dazzling & want_gc_soon: many thanks for your answers. I am thinking to apply for EAD as backup in case my H1B cannot be renewed. Do you think it is a good idea? IC
 
Jharkhandi I am not making money as you make buddy..I am just keeping my fingers crossed.. But still you didnt say, what to sign and what I should do for AC21??? Do let me know..

Immigrationcom: You apply EAD, it never hurts applying anyway.. ITs always good to have a backup of EAD as you said incase if H1B doesnt get approved..

Can a person use AC21 even for a contract job and not a permanent one. I mean with AC21, can a person do contracting with vendor working at the client?

Green card is meant for permanent job - you cannot work on contract with vendors.

Perhaps you would like to search on how good is one W2 and one or more 1099s!
 
What is the resolution for this? I thought that with AC21, I can take up a contracting position with a Vendor and work for a client, so cant I not take it up. If I can take a letter from the Vendor that its a permanent position, would that suffice?
