question on AP expiration and renewed AP

I have AP which expires on 12/22/2003. I also got the AP extension approved on Nov 19th (yesteday). I am travelling to India on Nov 23rd (sunday). It is unlikely that I would get my renewed AP in the mail by that time I start India. Can I ask my lawyers to send my renewed AP to India and come back on renewed AP as I am planning to stay longer in India. Is it legally OK as I am travelling after my AP extension is approved. Will I have any problems when I re-enter to US?

Please help me with your suggestions.

Usually it is recommended that you travel only with the AP you plan to use in HAND! I would advise you to return to the US, prior to the expiry of your second AP. On the eventuality that INS mail system screws up and your lawyer doesn't receive the AP before the end of your trip, you don't want to be left stranded.

But legally, I think you should be okay, travelled after AP approval! But the risk factor is up to you.

Thanks. I am planning to extend the return trip only if I get my extension approval in hand by that time my first AP expires. Hopefully I will get AP extension in the mail by then. Yep..you are right..cannot rely on INS mail systems...
