I came to US on March 1997 and My company said it will apply for GC on Jan 1998. Until 2001 they have never applied for GC. I got a wonderful offer from the client so i took the offer. My Greedy emplaoyer(College mate- Close friend of mine) took 45 days of my salary. He told me that i breached the contract so he wont pay me the Money. I left it and joined the Client. My new company applied for my Labor in Dec 27 2001 and State notice date is Jan 2nd 2002. After 1 1/2 years of wait i decided apply Labor for my through My friends company. Applied H1 for my wife and Applied Labor for My wife on Nov 2003 in RIR. State got approved in Jan 2004 and federal got approved in Mar 2004. We have applied for I140 and I485 on 16 April 2004 gave FP on Oct 30 2004. 1/31/05 we have received the mail that my wife's 140 is cleared. Now 485 is pending i am not sure how long it will take for my wife's 485 to be approved. In the mean time My state labor is cleared and it is forwarded to DOl on10/24/04. I did not apply for EAD and AP for me. We just applied for my wife(primary applicant) Now she is working on EAD. My 9 th year extension is just approved(1/31/05- valid until 3/16/05)
My question is
1. Can i apply for EAD and AP.
2. If so Can i go out of country and come back on AP and still continue work on H1 or my H1 will be invalid when i use AP.
3. or safe side apply for EAD and AP and dont go out of country and staty H1 as long as possible.
4. if so if i get my labor approved my company will ask me apply for 140 and 485.
5. Can i apply 140 and 485 with my comapny also as PD is Jan2002 on my case and my wife PD is Nov 2003.
6. Can i ask my employer to apply for 140 and then go for CP if my application is faster.
